  • HELP! Domain / brand infringement

    I discovered by accident today — when a third party asked us about shipping — that we appear to have a domain / brand infringement issue.
    The domain “pearsandpeaches.com” is selling a range of consumer goods. I checked with Whois / ICANN and that domain was registered after our trademark and domain pearandpeach.com was established.
    Recommendations?
    HELP!

    If you were in the United States, I would recommend getting a lawyer. They would write a cease-and-desist letter threatening legal action if it wasn’t stopped and then it would go from there. I don’t know what the rules are in Brazil or Mexico which I believe is where you operate.

    My first problem is, I don’t know their location. There is no info on the Web site. I’ve emailed ICANN to see if they can help. I just discovered — this is ridiculous — that if you want to see if a company name has been registered in the USA, you have to do a search on 50 different states. 
    They have even copied the logo design.

    Place the domain name on backorder and wait the two months before it expires. That domain is set to expire in July this year.

    Looks like a dodgy dropshipping site to me. They make no money so chances are they’ll just stop in July.
