    Hi, I’ve been asked to update an SDS for a cosmetic product (shampoo). In checking EU legislation (Directive No 1223/2009) cosmetics are exempt if supplied to an end user or professional use - finished cosmetic product. At this point I’m assuming these uses, but am puzzled as to why the original SDS existed. I’m still to establish if the use is in fact as above. What reasons could there be for cosmetics requiring an SDS? Perhaps a non end user (consumer)/professional (salon) use? I just want to have enough info when I approach the client when I say “I don’t think you legally need an SDS, but you still need to supply some not so detailed safety information” - Thanking you

    the only time you’re likely to need an SDS is for transport purposes

    there is no legal requirement for any kind of SDS for end users

    the relevant legislation is REACh Regulation 1907/2006, article 2, subsection 6 (page 31 here):

    “The provisions of Title IV [concerning SDSs] shall not apply to the following mixtures in the finished state, intended for the final user: […] (b) cosmetic products as defined in Directive 76/768/EEC [now superseded by the regulations]”

    And yet, a great many of our customers are asking for/requiring one for everything they sell, whether it’s a cosmetic or not. When Walmart or Boots or Aldi says you must supply one or they won’t buy from you, what are you going to do? (Especially considering that your competitors have no problems with providing one)
