  • Owning the IP of a formula with a Korean Manufacturer

    Hi all - I have a client that wants me to create two formulas and then do a tech-transfer with a Korean manufacturer. However, after speaking with a few Korean manufacturers, they don’t seem to understand the concept of “owning the IP of the formulas.” Even if I did do a tech-transfer with a manufacturer in Korea, they said that they would just sign an NDA with the brand. But that the concept of “formula ownership” doesn’t exist. 

    Does anyone have any insights to this? How does a brand go about owning their formulas if they manufacture in Korea?  

    In the US, it seems fairly easy to own the IP as long as you work with an independent chemist and do a tech-transfer with a manufacturer. Thank you everyone for any advice and input.
