  • Capryloyl Salicylic Acid patent

    Does anyone here have an understand of how the Capryloyl Salicylic Acid patent by L’Oreal works in the US? It’s supposedly exclusive to L’Oreal owned brands, but the ingredient is available from at least 2 suppliers. Would this patent only apply when certain claims or ingredient combinations are used or is no other company allowed to use it under any circumstances? Is there a particular date when the patent expires, or can it keep getting renewed? 

    I did my best to try to find the answers but didn’t come up with anything conclusive so I’m hoping someone here might have a better understanding.

    It would appear that the patent on Capryoloyl Salicylic Acid expired in 2017.

    What is the advantage of Capryloyl Salicylic Acid over salicylic acid?

    It is almost 3 times more expensive.

      LHA seems to be less irritating than salicylic acid thanks to its largest molecule. With the larger
      molecular size and along with its fatty acid structure has been shown to
      penetrate the skin slower than salicylic acid…
