Are professional products covered by FDA regulations?
I have an opinion about this but I wanted to know what other chemists have to say.
Can a spa or a brand like Image Skincare make more aggressive claims than a brand like Olay?

My opinion would be no, but…since they are meant for professionals, a more detailed description would be ok.
I’ve got another, similar question. Are cleansing products intended for professionals covered by FDA labelling regulations? See ZOLEX, for example.

I think if the products are being sold to consumers, they are covered by FDA labeling regulations.

And that’s exactly the argument I’ve had with some of our customers.
So, the question is: Are trained professionals - doctors, engineers, technicians, even mechanics - still considered consumers, or can they be treated differently?

This is what the FDA says…
“Since the FP&L Act applies only to consumer commodities and their packages as defined in the Act, cosmetic ingredient declarations are required only on the label of the outer container of cosmetics customarily sold at retail or used in the performance of services conducted within the households. It does not apply, for example, to products used at professional establishments or samples distributed free of charge, unless such products are customarily also sold at retail, even if they were labeled “For professional use only.”
I don’t know how they define “consumer commodities”
