  • Similar looking competitor designs - Do you have any protection from copycats?

    I see a lot of products, particularly on Amazon, that look exactly the same, same container, same graphic design, similar ingredients - only difference is often the brand name.

    Do the brand who’s being copied have any recourse against copycats if they only have a wordmark trademark and no design marks? Are design marks even a thing in cosmetics?

    Amazon was a big outlet for our private labeling business a few years ago- what you’re seeing might not be people ripping off others but just one private label brand doing a poor job of differentiating their products for their clients.

    As far as recourse for an actual design copycat I have no idea, you’d have to ask a lawyer.

    Yeah, a lawyer is pretty much the only protection against this.

    Maybe they are all buying generic, look-alike bottles and caps, instead of having them custom designed and made?

    They can copyright their label designs too.
