First, this is more of a legal question so while I'll give you my opinion & tell you about my experience, it is not a legal opinion & consulting a lawyer may be a better choice for you. Alright, with that out of the way...

To use the word Hydradiance you want to first make sure it is not trademarked by someone in the industry. If it is, you can't use it. Search the USPTO.gov site for registered trademarks in the US. Next, you would ideally have one of your suppliers provide you with an ingredients specially made for you that they call 'Hydradiance technology'. This could be an easy matter of asking one of your anti-oxidant or moisturizer suppliers to provide you a custom blend. Or you could specially mix your ingredients yourself and call it the Hydradiance technology. Just make sure you have a separate batch sheet for it and that you put it in your formula as a complete mixture rather than separate ingredients.

Hope that helps.

Hi Perry,

this is very useful.. :)

how about if we want to put the word "HYDRADIANCE" on our cosmetic products like complete phrase would be " contains Hydradiance technology for a full benefit of moistuizing and anti ageing". what do you think are the supporting documents that i need to substantiate our claim. we have incorporated anti oxidants and moisturizers on our formulations. is'nt this enough?
